***Queensland Ticket Laws***

Legislation which came into effect on 8 December 2006 makes it illegal to buy or sell tickets to certain events held in Queensland at a price greater than 10% above the original price.

The legislation only applies to tickets for events held at the following venues:

  • Brisbane Cricket Ground
  • Brisbane Entertainment Centre
  • Queen Elizabeth II Complex
  • Sleeman Sports Centre
  • Suncorp Stadium
  • Willows Sports Complex
Sellers considering listing tickets subject to the legislation should use the Buy It Now format and set a price that is not greater than 10% above the original price of the ticket.

Buyers purchasing tickets subject to the legislation should contact the company that issued the tickets for information on the event.

eBay is not a law enforcement agency and will be dependent on notification from the Queensland Police in the event of a suspected breach of the legislation.

***Federal Court decision on Big Day Out tickets***

Today an important Federal Court decision was handed down that a condition of sale for Big Day Out tickets is misleading and deceptive. eBay undertook action against the Big Day Out promoters in the interests of consumers who have been confused by claims that their tickets will be cancelled if resold for profit. This provides much-needed clarity to consumers.

The Court has found that the condition in question conveys a false representation that all tickets resold for profit will be cancelled. By claiming the condition is enforceable, the Big Day Out promoter has engaged in misleading and deceptive conduct toward members of the public.

Today’s judgment raises concerns about the implementation of ticket terms and conditions, which will need close inspection by the industry. In particular, promoters need to improve primary distribution and get tickets into the hands of genuine fans, rather than attempting to shut the gate after the horse has bolted.

***Introducing Best Match sort option in search results***

We're pleased to announce the launch of Best Match on eBay.com.au. Best Match is a new method of sorting the listings that appear on search results pages.

Best Match allows you to sort the listings you see based on their relevance. The relevance of a particular listing is based on past buyer behaviour, as well as the information in the listing title and description.

This means that what buyers do on the site affects the order in which listings are displayed in the future. If buyers who perform certain searches end up viewing, watching, bidding on or buying particular types of listings more often, then this will be factored into our relevance calculations.

For example, if buyers who search for 'flamingo' show over time that they prefer listings that also include the word 'pink' in the title, then over time those listings will be displayed higher up in the search results for 'flamingo'.

Best Match doesn't affect which items are displayed in search results, just the order in which they're displayed. The aim of Best Match is to help buyers find what they're looking for more quickly.

You can find the Best Match sort option by clicking the drop-down menu next to Sort By at the top of search results pages. If you want this to become your default method of sorting results, click the Customise Display link next to the drop-down menu.

***Issues with Selling Manager and Other Subscriptions ***

You may have experienced issues trying to use products such as Selling Manager, Selling Manager Pro, Picture Manager, Marketplace Research, and Sales Reports. Most members who use these subscription products have been restored.

We're aware that a few members may not have access to their subscription tool, or they may have access to a different version of the tool they subscribe to. (For instance, they can access Selling Manager Pro, but they are subscribed to Selling Manager.) A small number may find they have been subscribed to a tool they do not use.

We are working to resolve these issues, and appreciate your patience.

***Policy Change: Feedback Manipulation***

eBay has made changes to its Feedback policy to assist us in taking action against members who artificially inflate their feedback (feedback padding). Feedback padding allows dishonest members to portray themselves to others as more trusted because of their higher positive feedback rating.

The new Feedback Manipulation policy will enable us to take action against members when we identify a pattern of behaviour consistent with Feedback Manipulation. Violations of this policy may result in a range of actions including:

  • Listing cancellation
  • Limits on account privileges
  • Account suspension
  • Forfeit of eBay fees on cancelled listings
  • Loss of PowerSeller status
  • Feedback removal
Feedback is the foundation of trust on eBay. Purchasing, selling or trading Feedback undermines the integrity of the Feedback system and decreases trust within the eBay marketplace.
